Court grants injunction to restrain Adu from holding himself as NUGS prez

The National Union of Ghana Students (NUGS) has finally procured a court injunction to restrain Paa Quecy Adu from holding himself as its President.

The court order was granted on 26th November, 2015 after the plaintiffs sought the court to restrain Mr Adu from carrying himself as president of the Union to preserve the peace and tranquility in NUGS.

Mr Paa Quecy Adu had earlier indicated that he is still in office and has not resigned as reported by the media.

However, a statement signed by Thomas Takyi-Bonsu, said "It is obvious that, per the NEC resolution that set aside Paa-Quecy Adu from acting as the NUGS President, Mr Ferdinad Boakye the Applicant as per  Article 41(b) of the NUGS constitution carries the mandate of students as Acting president to act for and on behalf of NUGS.

COURT GRANTS INJUNCTION TO RESTRAIN MR PAA-QUECY ADU FROM HOLDING HIMSELF AS NUGS PRESIDENT

The general public is by this statement informed that a court injunction has been procured by NUGS to restrain Mr Adu from holding himself as its President. The court order [which is attached] was granted on 26th November, 2015 after the plaintiffs sought the court to restrain Mr Adu from carrying himself as president of the Union to preserve the peace and tranquility in NUGS. This line of action became necessary following the uncouth and crude methods of the suspended president to hold on to power.

The position of the law on the junction is as follows:

A party must establish some legal or equitable right at law which needs to be protected to maintain the status quo ante.

It is obvious that, per the NEC resolution that set aside Paa-Quecy Adu from acting as the NUGS President, Mr Ferdinad Boakye the Applicant as per  Article 41(b) of the NUGS constitution carries the mandate of students as Acting president to act for and on behalf of NUGS.

The court must be satisfied that there is a serious question or issue to be to resolved. The court sided with the argument(s) by the plaintiffs that, NUGS is threatened with a possible division(s) by the actions of the suspended President and hence remains a very serious issue for trial.

The effect of the order is to preserve the interest of the Ghanaian students. As a strong case had been made by the Applicant Mr Ferdinad Boakye for the interest of students, which has been upheld by the court, the inescapable conclusion would also be that, any person who associates with the suspended president to purport to act for NUGS would be cited for contempt.

Also, a COURT ORDER is to be obeyed to the letter, or risk FACING THE LAW.

NUGS will not accept responsibility for any actions initiated by Mr Adu purporting to act as an official of NUGS. The general public is hereby advised to refrain from dealing with Mr Paa-Quecy Adu in any capacity as a NUGS official. His actions are his own responsibility and not that of NUGS.
