Unending West Blue case; Afenyo Markin heads for supreme court

Lawyer for clearing agent, Michael Djan,  who filed an interlocutory injunction against Government's decision to out source destination inspection duties under the single-window inspection system at the ports to private company west blue has decided to head to the supreme court to issue a certiorari against government.

Justice Keneth Okwabie who presided over the  case in The Accra Human Rights Court on the 31st of August, denied the application for an injunction on grounds that documents available to the court reveal that the contract had already been signed.

This is on grounds that the Human Rights Court told the plaintiffs when they earlier filed for an injunction that the application was too early, as government had not made a concrete decision to award any contract to west Blue.

According Alex Afenyo Markin, that decision earlier, contradicts the latest decision by the court, that their application is too late.

"We are likely to file a process at the Supreme Court for cirtiorari. This will not be an appeal.  The same court cannot tell us that the application for an injunction was too early, and later tell us that our application is too late. Obviously there's a problem."

Alex Afenyo Markin further asserted that an appeal will not be enough for the kind of error that has been made here.

" In law, some errors cannot be corrected with an appeal. We are seeking the intervention of the apex court to deal with this error. We have decided that the ruling of the judge was too grave that we want the supreme court to use its supervisory jurisdiction to quash the verdict" he said.

Meanwhile, Deputy Finance minister, Mona Quartey is urging all private companies especially banks to take advantage of the the single-window scheme.

" There are a lot of banks in Tema who can take advantage of the single-window scheme to make some money for themselves.  This is an opportunity to make some profits. And  once we put all this system online, we will bring a lot of convenience to customers who will not have to physically go round looking for banks to finance their clearing activities."
