Court adjourns interlocutory injunction hearing by 22 judges

An Accra High Court has adjourned the case challenging the locus of the investigative committee set up by the Chief Justice to look into allegations of corruption resulting from an investigative piece by journalist Anas Armeyaw Anas to Friday.

The adjournment is to give ample time to lawyers for the magistrates to respond to an affidavit filed by the Attorney General asking for the court to dismiss entirely the suit brought against the Chief Justice and Judicial Council.

The AG request for an abridgment of time for the case to be heard tomorrow [Wednesday]

instead of the mandatory three days after an affidavit is filed saying it was of grave importance to the public.

The twenty two judges filed an application seeking to stop the procedure initiated by the Judicial Council to establish the truth. The accused judges say the five member Committee tasked to investigate the “scandal” is unlawful.

Meanwhile the injunction application filed in respect to the same case will also be heard on Friday.

The court also granted an application for substituted service filed by Justice Derry. Lawyers for Justice Derry were having a hard time serving Anas since his identify is unknown.

But the ruling of the court means that Anas will be deemed served once a notice is posted on the court notice board and a letter of the service mailed to him.
