The 36-year-old Miller made the crude comment after he got on the woman at a party and has sex with her after she had passed out during a drunken party.
Rape suspect says woman he assaulted was not even 'rapeable'
An Iowa, USA man, William Miller, stunned a court where he is standing trial for rape that though he slept with a drunk woman without her knowledge, the victim was not 'rapeable' according to his standards.
According to police report, Miller was hanging out and drinking with friends at a home in Iowa City last May and after everyone passed out for the night, he allegedly removed the pants of the victim and 'began having sex with her.'
He then told the police that the woman involved wanted to have sex and it was consensual all along.
A witness at the scene, however, said that he saw Miller on top of the woman and yelled at him to 'get away' from her. The witness said that he then woke up the woman and helped get her to the hospital so they could run a rape kit.
Miller is currently locked up in lieu of $26,000 in bail after it was discovered that in addition to the current sexual assault charges, he has a long track record of prior crimes including convictions for domestic violence, theft and harassment.
