Court dismisses laywers' petition to throw out case

The medical officer at Efia Nkwanta hospital is facing two counts of defiling a child under 16 years and having unnatural carnal knowledge, charges he has pleaded not guilty to.

 

A Gender based court has dismissed an application of 'no case' by lawyers for medical doctor Ali Gabass who has been accused of sexually defiling a sixteen year old boy.

According to the presiding judge, Rita Agyeman Budu it will be improper to dismiss the import of evidence given by prosecution witnesses at this stage. She further stated that the defense lawyers failed to provide enough evidence to prove the actual age of the victim, something they contended during the trail. The court also ordered Dr. Gabass to open his defense on the 13th of May 2015.

Dr. Ali Gabass was arrested in October 2014 after media reports alleging sexual activities with the senior high school boy.

The case which has mostly been heard in chambers has seen state prosecutors call five witnesses, including Joy FM’s Manasseh Azure Awuni.

Lawyers for Dr. Gabass on three occasions failed to have their clients bail application granted.

Meanwhile the legal team of Dr. Ali Gabass has announced they will appeal the ruling of the judge.
