The Greater Accra Police command has granted bail to five of the six suspects arrested in connection with the murder of the Abuakwa North MP Joseph Boakye Danquah Adu.
The late JB Danquah Adu was stabbed to death around 1.00 am on February 9, 2016 at his Shiashie residence in Accra.
However, after granting bail to the five suspects arrested in connection with the crime, one is still being held by the police after 48 hours.
Asked whether the suspect is not unlawfully being held beyond 48 hours, the police source said "It matters though but we have every reason. If we think we need more time, we will remand the person. But there are cogent reasons for keeping whoever."
This explanation seems to contradict Article 14(3) of the 1992 Constitution which provides that âa person arrested, restricted or detained shall be brought before a court within forty-eight (48) hours after the arrest, restriction and detention.â
So the question on the minds of many is whether the suspect with the police is being held unlawfully.
