Man who impregnated daughter, 10 has been charged with defilement; not incest

According to Nigeria’s department of state prosecution, Kenneth Abuya had regularly had sex with the 10-year-old girl, leading to the pregnancy.
The News Agency of Nigeria reported that Mr. Abuya is facing a count charge of defilement. Unless the defilement charge is just a provisional one, it is not clear why incest was not of priority to the prosecutors.

State prosecutor, Simeon Imhonwa told the court presided over by Chief Magistrate, Mrs. B.O. Osunsanmi of the Ikeja Chief Magistrates’ Court that, “The accused forcefully had carnal knowledge of his child on Nov. 29 at his residence and threatened to kill her if she would tell anyone about the crime.’’
He added that “The accused had been defiling the girl before he was apprehended.

“The victim’s mother reported the case to the police after their daughter narrated her ordeal.”
The accused is being tried based on section 137 of the Criminal Law of Lagos State 2015.

The case has been adjourned until Feb. 2, 2018, and in granting the bail, Mrs. B.O. Osunsanmi ordered that the two sureties must be property owners in Lagos State and should have evidence of tax payment to the state government, according to africanspotlight.com.
