Supreme Court's verdict is victory for our democracy - EC
Thaddeus Sory, the lawyer for the Electoral Commission has said that the judgment handed by the Supreme Court of Ghana asking it to allow the PPPs presidential candidate Dr Papa Kwesi Nduom to correct his nomination form errors is victory for democracy.
The Seven-member panel in the ruling on Monday, November 7, 2016 also asked the election management body to extend the nomination period to November 8 and allow the parties to correct their mistakes in order to contest the polls.
"EC ordered to extend close of nomination period from today Monday to Tomorrow Tuesday, and invite all disqualified aspirants and afford them a hearing towards necessary corrections on their nomination forms. All pending cases on disqualification of aspirants stayed. EC to comply with orders with IMMEDIATE EFFECT," the Supreme Court presided over by Justice, Sophia Adinyira ruled.
The EC disqualified Dr, Papa Kwesi Nduom and 12 other people from the December polls for various errors detected in their nominations.
But the High Court presided by Justice Kyei Baffuor ruled that the EC was unfair in the decision.
The EC subsequently in a statement said “Having carefully studied the contents of the judgment, we respectfully disagree with the High Court judge’s decision on several essential legal and public policy grounds.”
But speaking to the press after the Supreme Court’s judgment, Mr Sory said: “This is victory for democracy. The court was very categorical in its orders.”
“We (EC) came here on three grounds – error of law, wrongful assumption of jurisdiction, and excess of jurisdiction, and the court agreed with us that while it was evident that there was an error of law on the face of the record, it did not go with the (High) Court’s jurisdiction and so it wouldn’t quash it (High Court ruling), the court dismissed our second ground but upheld the third ground,” he said.
