In a notice letter to the EC on May 8, a lawyer for the group, Nana Obiri Boahene, said the action has become necessary because of the “uncooperative and lackadaisical attitude” of the commission in creating the necessary condition for the implementation of the law.

The Electoral Commission has been threatened with a court action over the implementation of the Representation of the People’s Amendment Law (ROPAL) by some group of Ghanaians living in abroad.

The letter also said there will be another general election in 2020, adding that arrangement must be made to ensure eligible Ghanaians staying outside the country can vote.
“We will resort to whatever legal means readably available to ensure that eligible Ghanaians outside do exercise their franchise,” the notice letter to the EC warned.
The law, if implemented, will allow Ghanaians living in abroad to vote in the presidential elections.
The law came into force in February 2006 but has since not be implemented by the EC.

The commission has cited logistical and financial challenges as part of the reasons for the failed implementation of ROPAL.
