Dr Nduom is seeking an injunction on the balloting “for a position of presidential candidates for the 7th December 2016”.

The Chairperson of the Electoral Commission is also joined to the suit as a respondent.

The counsel of Dr Nduom is also requesting that the EC Chair be directed to allow him to correct the anomaly on his nomination forms so he can contest as a presidential candidate in the upcoming December 7 polls.

On reasons why the PPP’s Papa Kwesi Nduom was disqualified, the EC Chair said: “the Commission is unable to accept Dr Nduom’s nomination because again the number of subscribers in his forms did not make the requirements of regulation 7(2) of CI 94.”

The details are as follows, one subscriber, Mr Richard Aseda, with voter ID number 7812003957 endorsed Dr Nduom’s forms in the Central region and again endorsed the same forms with the same ID number in the Volta region.

She said: “the same subscriber, Mr Richard Aseda endorsed the form with different signatures in both portions of the nomination forms. This again raises questions as to the legitimacy of one or both signatures.”

The EC Chair added, “the Commission will again refer the matter of a possible forgery of signatures to the Ghana Police Service and the Attorney General for investigation and prosecution in line with the Criminal Offence Act.”

The Electoral Commission (EC) has since reported the 13 disqualified presidential nominees to the police for the various electoral and criminal offences identified during the vetting of their nomination forms.

The offences include:

Section 211: Perjury

Section 248: making false declaration etc. for office or voting

Section 251: Deceiving a public officer

Section 256: Corruption, Intimidation and personation in respect of the election.

Meanwhile, nominations of President John Mahama of the National Democratic Congress (NDC), Nana Akufo-Addo of the main opposition New Patriotic Party (NPP),  Ivor Greenstreet of the Convention People’s Party (CPP) and Jacob Osei Yeboah – an independent aspirant have been accepted by the EC.
