Court to rule on PPP suit against EC over disqualification today

At the hearing on Tuesday, October 25, the Electoral Commission (EC) prayed the court to throw out the suit by the Progressive People’s Party (PPP) for failing to go through the right procedure.

An Accra High Court presided over by Justice Kyei Baffuor will today (Friday, October 28) rule on the PPP’s suit against its disqualification in the 2016 presidential race.

According to the lawyer for the EC, Thaddeus Sory, the applicants should have come before the court with a petition, rather than a certiorari.

He further told the court that it had no powers to order it to accept nominations forms by the PPP.

But counsel for the PPP’s Presidential candidate, Ayikoi Otoo challenged the EC's disqualification of his client arguing it has no basis in the Commission's own law.

According to him the Constitutional Instrument (CI 94), the regulation governing the 2016 general elections does not provide for the disqualification of any candidate.

Nii Ayikoi Otoo, counsel for the PPP's Presidential candidate, Dr Papa Kwesi Nduom, has challenged the Electoral Commission's disqualification of his client arguing it has no basis in the EC's own law.
