Case adjourned Supreme court orders state to file response in GBA's petition

The seven member panel of judges hearing the suit by the Ghana Bar Association challenging the President’s appointment of Justice Yaw Appau and Gabriel Scott Pwamang have given the AG a fourteen days ultimatum to file their response to the suit brought against it.

According to the judges who were unhappy about the attitude of the state in the case, they were surprised at the state's delay in responding to the suit which was filed about some five months ago.

The court also ordered two applicants with a similar case Richard Dela Sky and Proffessor Kwaku Danso to consolidate their cases with that of the GBA.

The Ghana Bar Association (GBA) and three others instituted legal action to bring an end to what they termed “persistent” failure of Presidents in the Fourth Republic to seek the advice of the Judicial Council before appointing judges to the Supreme Court.

In a 66-page writ of summons and statement of case seeking to invoke the original jurisdiction of the Supreme Court, the plaintiffs prayed the court to direct the Head of State to fully comply with Article 144 (2) and (3) of the 1992 Constitution which admonishes the President to appoint justices to the Supreme Court upon advice from the Judicial Council.

The case has been adjourned sine die.
